hi to all....im driving my yamaha mio going to a hardware just to buy some few things...mabagal lang ang pagdra-drive kc madami tao sa kalsada at my angkas pa me ....nang biglang may batang tumakbo galing sa kaliwang side mabilis sya at nabangga nya kmi at sya ay natumba at nagalusan....middle side nya kmi nabangga .....its not my fault.....sa gitnang side lapit sa manibela sya bumunggo at not in front ng motor...tumayo ung bata at tumakbo pauwi sa bahay nila...ang ginawa ko pinatawag ko ung bata at guardian nya at dinala nmin sa hospital para ma check up at x-ray.......me ang gumastos.....ask ko lang kung tama po ba ang ginawa ko kahit lam ko nmn po sa sarili ko n di kasalanan ang nangyari....ang sbi ng magulang nung bata sagutin ko daw ung mga magiging gastosin pa nung bata s..kung ano pa ang nid sa treatment nya....tama po ba un o mali?.....need advice badly.....

Your dilemma is not really a purely legal question. In a settlement, even when you feel you are not at fault, your willingness to settle is based on 1) your humanitarian need to help your fellowman and 2) your desire to avoid the cost and hassle of being embroiled in a case. Unfortunately, you pay with money and inis dahil you believe hindi ikaw ang may kasalanan.

At this point, it can only be up to you to decide which course to take, knowing the consequences of each choice you have. If you feel you've done enough, and don't think the parents are so willing to file a case, then you can take your chance and refuse.
